Scope of Application

These Terms and Conditions (T&Cs) apply to all services ordered by customers on-site at BagAuthentic, via the website BagAuthentic.com, or through personal contact. The services are initially provided exclusively at the location Handbag Spa & Shop, Leibnizstraße 59, 10629 Berlin. Special agreements are possible.

Subject Matter of the Contract

BagAuthentic offers services for the authentication and damage assessment of Hermès and Chanel leather goods. The assessment services are provided exclusively on-site by appointment. Authentication or damage assessment can also be individually agreed upon and performed at your location. However, this requires a separate written agreement.

Conclusion of Contract

The contract is concluded when the customer schedules an appointment for authentication or damage assessment and delivers the leather goods to be evaluated either personally at BagAuthentic's location or through a messenger. Upon delivery of the goods and agreement to these T&Cs, the customer receives a binding offer. The contract becomes effective upon written confirmation by BagAuthentic.

Prices and Payment Terms

The prices for authentication and damage assessment are listed on the website or directly on-site. The prices stated at the time of service booking apply. Payment is due immediately after the service is provided, either in cash or via available payment methods such as EC card or credit card.

Provision of Services

Authentication and assessment services are generally provided directly at the location Handbag Spa & Shop, Leibnizstraße 59, 10629 Berlin. The customer brings the leather goods to be assessed to the scheduled appointment. After the evaluation, the goods will be returned to the customer immediately upon completion of the service.

Right of Withdrawal

Since the services are provided on-site and with the customer's explicit consent immediately after the order is placed, the right of withdrawal expires once the service is fully performed. Before the service is provided, the customer has the right to withdraw from the contract at any time; typically, the appointment should be canceled at least 24 hours in advance.

Liability

BagAuthentic is liable for intentional or grossly negligent breaches of duty. For minor negligence, we are only liable in the event of a violation of essential contractual obligations, the fulfillment of which is necessary for the proper execution of the contract and on which the customer may regularly rely. For damages to the leather goods during the evaluation, we are only liable in the case of gross negligence or intent.

Warranty

The services for authentication and damage assessment are performed to the best of our knowledge and belief. However, BagAuthentic does not guarantee the absolute accuracy of the authentication results.

Final Provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If individual provisions of these Terms and Conditions are or become invalid, the rest of the contract remains valid.

Exclusion Clause

BagAuthentic assumes no liability for:

• The authenticity of leather goods if, due to insufficient or incorrect information provided by the customer or missing documentation, an unambiguous authentication is not possible.
• Damage caused by improper handling or care of the leather goods by the customer before or after the authentication.
• Indirect damages or lost profits that the customer may incur by using the service.
• The results of the authentication if the leather goods are in a heavily worn or damaged state or have already been technically devalued when submitted. Such circumstances affect the evaluation and should only be reliably made upon inspection of the original goods.

BagAuthentic is liable only for damages that occur during the processing of the leather goods on-site due to gross negligence or intent. The maximum liability is limited to the replacement value of the goods or their current value.

Right of Withdrawal

As a consumer, you have the right to withdraw from this contract within 14 days without providing any reason, provided the service has not been fully performed. The withdrawal period is 14 days from the date of contract conclusion. Withdrawal is only possible if the authentication or damage assessment service has not been performed. Once the service is fully executed at the customer's explicit request before the withdrawal period expires, the right of withdrawal is void. To exercise your right of withdrawal, you must inform us (BagAuthentic, Leibnizstraße 59, D - 10629 Berlin, Email: [email protected], Phone: +49 30 554 69 475, Leibnizstraße 59) of your decision to withdraw from this contract through an unequivocal statement (e.g., via email or letter). To meet the withdrawal deadline, it is sufficient for you to send the notification of your withdrawal before the withdrawal period expires.

Consequences of Withdrawal

If you withdraw from this contract, we will refund all payments we have received from you without undue delay and no later than 14 days from the day we receive your withdrawal notice. We will use the same payment method that you used for the original transaction, unless expressly agreed otherwise.

If you have already made a deposit for a service that has not been fully provided, we will refund the full amount. However, if the service has already been fully performed at your express request before the withdrawal period expires, your right of withdrawal is void, and no refund is possible.

For the conclusion of the contract, the German language is available.
